San Francisco, Ca. — U.S. District Chief Judge Vaughn R. Walker has denied the motion to extend the stay of his August 4, 2010 decision overturning the 2008 same-sex marriage ban.
Judge Walker's decision will lift the current stay of the decision on August 18, 2010 at 5:00pm pst.
The denial of the stay means that same-sex couple are able to be married in the State of California on August 18, 2010 at 5pm pst.

The decision to deny the stay extension will most likely be appealed by anti-equality defendants but will have to overcome legal hurdles including if they have legal standing to appeal and the likelihood of the success of their appeal.
Gov. Arnold Schwarzenegger and Atty. Gen. Jerry Brown refused to defend Proposition 8 and have both stated that they oppose appeal of the decision. The sponsors of the 2008 initiative had defended the case before Judge Walker.
